 Pen and Colors – Terms & Conditions

1. Acceptance of Terms 

By commissioning services from Pen and Colors (hereafter "the Designer"), the Client agrees to these Terms & Conditions.  

2. Services & Deliverables 

  • The Designer agrees to provide graphic design services (e.g., logos, business cards) as described in the project proposal/quote.  
  • Deliverables will be provided in PNG, PDF, SVG, or other agreed formats.  
  • Turnaround time depends on the selected package (e.g., 48 hours for rush orders). 

3. Payment Terms 

  • Deposit: 50% non-refundable deposit required to begin work.  
  • Final Payment: Remaining 50% due before final files are delivered.  
  • Late Payments: 5% fee applied after 7 days of due date.  
  • Payment Methods: PayPal, Stripe, or bank transfer. 

4. Revisions & Approval 

  • Revisions are limited to the number specified in the purchased package (e.g., 2 revisions for Basic Logo).
  •  Additional revisions billed at $20/hour.  
  • Client must provide feedback within 5 business days or risk project delays. 

5. Intellectual Property 

  • Copyright Transfer: Full rights to final designs are granted to the Client only after final payment.  
  • Designer’s Rights: The Designer retains the right to display work in portfolios, social media, or marketing materials.  
  • Client Warranty: Client confirms all submitted materials (e.g., images, logos) are legally owned or licensed. 

6. Cancellation & Refunds 

  • In a case, where "Client" cancels an order; 
  1. Deposit is non-refundable.  
  2. Partial refunds for work completed may apply at the Designer’s discretion. 
  •  In a case, where "Designer" cancels an order; 
  1. Full refund issued if the Designer cannot complete the project. 

7. Liability & Limitations 

  • The Designer is not liable for:  
  1. Delays caused by the Client (e.g., late feedback).  
  2. Losses from misuse of designs (e.g., trademark infringement by Client). 
  • Third-Party Assets: Client is responsible for licensing stock images/fonts not provided by the Designer. 

8. AI-Generated Content 

  • AI tools (e.g., Canva Magic Design) may be used, but final designs are curated by the Designer.  
  • Copyright ownership of AI elements follows jurisdictional laws. 

9. Confidentiality 

  • The Designer will not share the Client’s sensitive information (e.g., unreleased products) without consent. 

10. Governing Law 

  • These Terms are governed by the laws of [Your Country/State]. 
11. Amendments 
  • Terms may be updated with 14 days’ notice via email or website announcement. 
Client Agreement 
  • By submitting payment, the Client agrees to these Terms & Conditions.
